AI Acceptable Use Policy

Real Magic, Inc. d/b/a Levitate (the "Company," "we,"or "us") maintains the Services. This AI Acceptable Use Policy (this "AUP"), along with the Company's Terms of Service (located at levitate.ai/terms-of-service) (the "Terms") govern your access to and use of the Services. Capitalized terms used herein but not otherwise defined have the meaning ascribed to them in the Terms. This AUP is incorporated into and forms part of the Terms. By accepting the Terms, you agree to read, adhere to, and be bound by this AUP in all respects, as updated from time to time.

General Prohibited Uses

The AI Models may not be used for:

(a) facilitating real money gambling or payday lending;

(b) engaging in political campaigning or lobbying, including generating campaign materials personalized to or targeted at specific demographics;

(c) deterring people from participation in democratic processes, including misrepresenting voting processes or qualifications and discouraging voting;

(d) predicting or categorizing based on an individual's protected characteristic, including, but not limited to, racial or ethnic origins, and past, current, or future political opinions, religious or philosophical beliefs, trade union membership, age, gender, sex, sexual orientation, disability, health status, medical condition, financial status, criminal convictions, or likelihood to engage in criminal activities;

(e) submitting images, videos or audio recordings of individuals without consent for the purposes of creating, analyzing, or categorizing based on, biometric identifiers, such as face prints or fingerprints or scans of eyes, hands, voiceprints, or facial geometry;

(f) detecting, inferring, or assessing individuals' emotions in the workplace or in educational institutions;

(g) deploying subliminal, purposefully manipulative or deceptive techniques that impair an individual's ability to make an informed decision;

(h) causing harm by intentionally deceiving or misleading others, including, but not limited to: (i) generating or promoting disinformation, misinformation, or false online engagement; (ii) impersonating another individual or organization without consent or legal right; (iii) engaging in or promoting academic dishonesty; and (iv) failing to ensure automated systems disclose to people that they are interacting with artificial intelligence;

(i) directly developing, controlling, using or operating weapons, or explosives;

(j) reverse engineering, decompiling, disassembling, or otherwise attempting to discover the source code, object code or underlying structure, ideas, know-how or algorithms relevant to the Services, the Software, the Materials or the AI Models;

(k) providing, reselling, sublicensing; or otherwise making the Services available to any third party;

(l) circumventing, disabling, or interfering with any security or access controls, or attempting to probe, scan, test the vulnerability of, or hack into the Services, the Software, or the AI Models;

(m) building systems intended to replicate or compete with the Services or the AI Models;

(n) developing or using a mechanism for the purposes of monitoring the availability, performance, or function of the Services or gathering any insights into the Services in any respect (including, but not limited to, for benchmarking purposes); and

(o) attempting to gain or enabling unauthorized access, whether directly or indirectly, to the Services, the Software, or the AI Models.

Prohibited High-Risk Uses

In addition to the general prohibited uses described above, you agree not to use the Services, the AI Models, or any Output as the sole or a substantial basis for, or as a substantial factor in, any of the following ("Restricted Decisions"), whether on your own behalf or on behalf of any third party: (a) decisions regarding the extension, denial, modification, pricing, or terms of credit, loans, or other financial products, including any Output used as a credit score, creditworthiness assessment, or basis for an adverse action notice; (b) insurance underwriting, rating, pricing, binding, renewal, non-renewal, cancellation, claims handling, fraud scoring, or risk classification; (c) employment decisions, including recruiting, hiring, promotion, discipline, termination, compensation, scheduling, performance evaluation, or productivity monitoring of any employee, contractor, or candidate; (d) housing or tenancy decisions, including rental application review, lease pricing, eviction, or tenant screening; (e) the provision of legal advice, the drafting of legal opinions, or any activity constituting the practice of law in any jurisdiction; (f) medical advice, clinical diagnosis, triage, treatment recommendations, or any activity regulated as the practice of medicine, including use as a medical device or clinical decision support tool; (g) investment advice or securities recommendations regulated under the Investment Advisers Act of 1940 or comparable state or foreign law; (h) tax advice regulated under IRS Circular 230 or comparable state or foreign law; (i) any use that would cause the Services to constitute a "high-risk artificial intelligence system," an "automated employment decision tool," an "automated decision-making technology," or any similar term as defined under applicable federal, state, local, or foreign law, including the Colorado Artificial Intelligence Act, the EU Artificial Intelligence Act, and New York City Local Law 144, each as enacted or amended; and (j) any use that generates, in whole or in part, a score, rating, ranking, classification, estimate, prediction, projection, forecast, approximation, or other quantitative assessment that will be used to make or substantially influence any Restricted Decision listed in (a) through (i).

Customer Responsibilities

You are solely responsible for:

(a) ensuring your use of the Services complies with privacy, security, artificial intelligence, and sectoral laws applicable to you;

(b) ensuring downstream uses and Outputs are subject to meaningful human oversight where required;

(c) preventing uses of the Services and/or Outputs that result in Restricted Decisions;

(d) preventing unauthorized access; and

(e) promptly notifying us of suspected misuse or security incidents.

Monitoring and Enforcement

We may monitor third party use of the Services to confirm compliance with the terms of this AUP and any other applicable Company policy. We maintain the right to monitor all such usage by any means we deem appropriate, at any time, in our sole discretion and delete any material we deem illegal, inappropriate, or violative of any Company or applicable third-party policy. If we discover a violation, we will take whatever action we deem reasonably necessary or appropriate to address such behavior, including, but not limited to: (a) disclosing the user's personal information to a third party claiming that such user violated rights (such as intellectual property or privacy rights), where permitted or required by applicable law; (b) taking legal action (including making a referral to law enforcement); (c) immediately suspending or terminating the user's access to the Services in accordance with the Terms; (d) implementing technical or operational controls (including model refusals, Output filtering, and Account-level restrictions); and/or (e) requiring you to certify in writing the deletion of any Outputs generated in violation of the Terms and/or this AUP. YOU HEREBY WAIVE AND HOLD HARMLESS THE COMPANY, ALONG WITH THE COMPANY'S EMPLOYEES, OFFICERS, DIRECTORS, AFFILIATES, LICENSEES, AND SERVICE PROVIDERS, FROM ANY AND ALL CLAIMS RESULTING FROM, OR ARISING DIRECTLY OR INDIRECTLY OUT OF, ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES IN CONNECTION WITH INVESTIGATIONS BY EITHER THE COMPANY OR LAW ENFORCEMENT AUTHORITIES.

Modifications and Updates to this AUP

We reserve the right to modify and update this AUP at any time in our sole discretion. You should check our website frequently to see recent changes. When we change this AUP in a material manner, we will update the 'last updated' date at the top of this page. If you object to any changes, you may close your Account. Continuing to use our Services after we publish changes to this AUP means that you are consenting to the changes.

Reporting Violators

We request that any user who believes that a violation of this AUP or any other Company policy has taken place should report the alleged violation to us promptly. Such report shall be sent to Security@levitateapp.com. The following information should be included:

(a) name of alleged violator(s);

(b) date and time (including time zone) of the alleged violation(s);

(c) the IP address(es) used to commit the alleged violation(s);

(d) description of alleged violation(s);

(e) evidence of the alleged violation(s) (including screenshots and videos); and

(f) the reporter's involvement, if any, in the violation (and how the violation was discovered in the first instance).

The identity of those who report known or suspected violations will be maintained by us with the utmost secrecy at all times, subject to legal obligations.
